Description
Defendant was convicted after trial by jury of the crime of harassment, a misdemeanor. ORS 161.065(1)(a). On appeal, defendant challenges the validity of a curfew as a condition of probation. The court suspended execution of a 60-day sentence, placed defendant on "bench" probation for two years, required 48 hours of community service and ordered her to obey all laws and a 10 p.m. curfew for two years, unless she needs to be out for work-related purposes. Defendant contends the imposition of the curfew condition is "excessive" on the ground that it is not reasonably related to the nature of the offense or to the purpose of rehabilitation. We affirm.
